Ok, heres how this game works:

I state something that is either legal or illegal, and you must decide whether it is legal or not. Give a reason why legal or illegal.

First question!

Is burning a CD for your neighbor, friend or family member legal, or illegal?

Depends on what's on the CD:
 - Pictures from your birthday party: legal
 - Photoshop: illegal
 - The latest Pink album: illegal (not to mention how awful your taste is!)

Napster is legal
Kazaa is illegal
Walmart.com better be legal. =P

Rest of them I don't really know, but now since Napster is a paid service it's legal.

Just to help clear up the issue of CD Cracks, since a lot of people seem confused about whether it's legal or not.

I quote NWN's end-user license agreement (yes I do read them). Pay close attention to what is in the parenthesis.

No Kazaa is not legal you have to read it very carefully it says "which functions similarly to Kazaa" meaning not kazaa but somthing similar to it. To say that kazaa is legal from the info given there is like saying a toaster is an oven because they both heat things.

Basically, it is illegal to modify the CD-authentication, which is what a crack does.

I dont know if its illegal where you all live but i use a program called alcohol 120 to make iso of my games so i never need it again and i can never lose it (unless i delete it) and you dont need to crack your game if you dont have the CD (it kicks ass for LAN parties)

Technically, if you burn a copywritten CD (ie published by a legally established company) it is for backup purposes only. The actual information on your CD can only be installed on one computer at a time , hence the reason for the CD Key and CD authentication.

I can go into much more detail, but basically the software companies are both covering their asses legally in case some 3rd party software breaks their product AND giving themselves room to bring legal action against the end-user for the even the smallest infractions.

Not only that, but you can put your original game CD in storage and use the copied CD instead. I recommend this as standard practice to everyone since blank CDs and CD burners are so cheap now. There is no reason to ever risk wear and tear on your original programs CDs, just make copies and use them until they get scratched, broken or lost. (hint hint Elessar)
